Please find below our prices for the preparation of Wills and Powers of Attorney. Please note that we encourage you to take advantage of our all-in-one solution package of all three documents. Our fees are as follows:

Mutual Wills and Powers of Attorney (Property & Personal Care): $500.00 + HST (65.00); total of $565.00.

($600.00 + $78.00 for blended families)

Mutual Wills without Powers of Attorney: $400.00 + HST (52.00); total of $452.00.

Single Will and Powers of Attorney (Property & Personal Care: $320.00 + HST (41.60); total of $361.60.

Single Will without Powers of Attorney: $280.00 + HST (36.40); total of $316.40

Each individual Powers of Attorney: $120.00 + HST (15.60); total of $135.60

Hourly rates regarding the services in general

 

The hourly rate for Roger Trudel is $280.00. This rate applies mostly where litigation or family law is involved but also to some extent, in matters concerning wills and real estate where the situations are more complex or become more complex as the file progresses or where the client demands are simply outright outside of the ordinary.

PLEASE NOTE: Payments are acceptable by cheque payable to Trudel Law Office or by cash. In addition, if need may be, arrangements concerning fees can be discussed with our lawyers. Please note that in most instances, the price will increase by $100.00, in the case of a second marriage or union and that the fees will increase in more complex situations. Prices appearing on the web site are subject to change without notice.

Real estate services

 

To the extent possible, the Office attempts to provide a form of flat rate to the client and the following are the quotes that the office gives subject to all conditions being relatively normal.

Fess for the Conveyancing portion of the sale of a single family dwelling in an urban area, with only one mortgage to discharge, where the agreement is already arrived at and where the sale price of the dwelling is less than $350,000.00, where the owners continue to form a couple, as applicable: $740.00 plus HST ($96.20), with a total fee portion of the invoice being $836.20 inclusive of the hst.

Anticipated disbursements in a sale transaction, rounded to $150.00 for the sake of a speedy conversation but with the more detailed approach below, namely:

Mandatory insurance premium payable to Lawpro, the professional indemnity company for lawyers : $65.00;

Sub-search of title ($18.50) and name verification ($22.00 estimated, at $11.00 per name): $40.50; and

Allocation for courrier/messenger charges, photocopies, mileage and communications charges, inclusive of HST: $56.50.

The above total of disbursements is $143.00 and one must ensure that the holder of the mortgage assumes the cost of the registration of the discharge of the existing mortgage (which the bank normally covers) otherwise the cost of the registration of the discharge is added to the lawyer’s invoice ($70.50).

The above explains the normal fee and disbursement invoice of $773.00 in a routine case.

Fess for the Conveyancing portion of the purchase of a single family dwelling in an urban area, with only one mortgage to complete and register, where the agreement is already arrived at and where the purchase price of the dwelling is less than $350,000.00, where the purchasers either form a couple or where the purchaser is acquiring the property as an individual owner, as applicable: $890.00 plus HST. ($115.70)., for a total fee portion of the invoice being $1005.70 inclusive of the HST.

Added to these basic fees are the routine disbursements which are rounded to $800.00 for the sake of a speedy conversation but with the more detailed approach set out further below there is the also the Land Transfer Tax and the applicable other contract disbursements which stem from your agreement of Purchase and sale arrived at with the builder if applicable.

In the case of the purchase of a condominium unit, the disbursement list is different than what is set out below because of the title insurance being less and because of the possible disbursement of $100.00 to obtain the condominium status certificate. In the end, the general quote on disbursements is very similar since the above two different disbursements end up canceling one another.

One must also note that where the lawyer is involved in the drafting of the agreement of purchaser and sale in a private transaction of the type of a for sale by owner (FSBO), a separate discussion must take place with the lawyer to canvass the amount of involvement which is expected from the lawyer and the fees that will result therefrom; a minimum fee of $300.00 plus HST ($39.00) would apply. The same will apply where the lawyer is expected to review, analyse and comment on the agreement of purchase and sale supplied by the builder, prior to the purchaser being in a position to confirm with the builder that the agreement is fully acceptable.

Now with the probable estimate as to the disbursements on a purchase:

1. Title search: $170.00;

2. Title Insurance if taken with Stewart Title: $278.00;

3. Registration of each instrument being the Transfer and the Mortgage at $70.50 each instrument): $141.00

4. Municipal Tax certificate where it is believed that one is needed or where the lender does insist on obtaining one: $60.00;

5. Search regarding the names of the vendors and those of the purchasers to avoid last minute surprises with similar names, at $11.00 per name: $88.00;

6. Possible need to obtain a sub-search of the title where there has been activity on the title between the date of the search and the moment of the registration of the transfer and the mortgage: $18.50; and

7. Allocation for courrier/messenger charges, photocopies, mileage and communications charges, inclusive of HST: $56.50.

Fees for the Conveyancing portion of the refinancing of a single family dwelling in an urban area, with only one mortgage to complete and register, and only one mortgage to discharge and no more than two credit card or other debts to be paid from the monies received in trust, where the agreement is already arrived at and where the amount of the refinancing is less than $350,000.00, where the purchasers either form a couple or where the client is refinancing the his own property as an individual owner, as applicable: $800.00 plus HST. ($104.00); for a total fee portion of the invoice being $904.00 inclusive of the HST.

Now with the probable estimate as to the disbursements on a refinancing:

1. Title sub-search: $18.50;

2. Title Insurance if taken with Stewart Title: $180.00.00;

3. Registration of the Mortgage at $70.50 for this only instrument: $70.50

4. Municipal Tax certificate where it is believed that one is needed or where the lender does insist on obtaining one: $60.00;

5. Search regarding the names of the client(s) to avoid last minute surprises with similar names, at $11.00 per name: $44.00;

6. Possible need to obtain a sub-search of the title where there has been activity on the title between the date of the search and the moment of the registration of the transfer and the mortgage: $18.50; and

7. Allocation for courrier/messenger charges, photocopies, mileage and communications charges, inclusive of HST: $52.50.

Here again, the above total of disbursements is $143.00 and one must ensure that the current holder of the mortgage assumes the cost of the registration of the discharge of the existing mortgage (which the bank normally covers) otherwise the cost of the registration of the discharge is added to the lawyer’s invoice ($70.50).

The above explains the normal fee and disbursement invoice of $773.00 in a routine case.

Divorces:

 

Where an appropriate written separation agreement is already in place and it is not at all expected that the divorce will be opposed or that the Respondent will seek to modify the existing agreement, it can be expected that the fee portion of the services to obtain a divorce judgment will be $1,200.00 plus HST ($156.00), for a total fee portion of the invoice being $1356.00. In more complex situations, the applicable hourly rates then in force will apply. It is client client’s responsibility to locate his/her spouse and to provide the marriage certificate, although the office may offer to assist for an additional fee and the appropriate disbursement.

As to the disbursements, they can be rounded off to $620.00 for the sake of discussion and they are set out below in more detail.

1. Amount payable to the Minister of Finance to initiate the divorce proceeding: $167.00;

2. Estimate as to the amount payable to the process server to serve the divorce application upon the respondent: $100.00;

3. Amount to file the Affidavit for Divorce to seek to obtain the divorce judgment: $280.00;

4. Amount payable to the Minister of Finance to obtain the divorce certificate: $19.00;

5. Allocation for courrier/messenger charges, photocopies, mileage and communications charges, inclusive of HST: $56.50.

Certificate of appointment of Estate Trustee with a Will.

it can be expected that, for the strict procedure above identified, the fee portion of the services to obtain a divorce judgment will be $2,000.00 plus HST ($260.00), for a total fee portion of the invoice being $2,000.00. In more complex situations, the applicable hourly rates then in force will apply. It is client client’s responsibility to locate the beneficiaries of the estate, to finance the conduct of the file and the appropriate amount payable as Probate fee to the Minister of Finance, his/her spouse and to the accounting resources necessary to advance the file, although the office may offer to assist for an additional fee and the appropriate disbursement.

The following criteria must be present for the above fee to apply

1. an appropriate original written Last Will and Testament must be in place;

2. the Executor/Executrix of the Will must have the same in his/her possession;

3. the team of Executors/Executrixes must get along well and must be on the same wave length as to the conduct of the file;

4. the situation must be that it is not at all expected that the application to seek the Certificate will be opposed in any way shape or form and the lawyer is not to be concerned with any secondary issue whatsoever, including, without limiting the above, to whom a specific gift is to be paid, how t trace the whereabouts of a beneficiary, who is to follow-up with the  filing of the income tax returns and the ultimate distribution of the estate.

As to the disbursements, they can be rounded off to $112.00 for the sake of discussion (other than the probate fee payable to the Minister of Finance) and they are set out below in more detail.Incorporations.

1. Amount payable to the Minister of Finance to initiate the application proceeding: (please refer to the Attorney General of Ontario web-site);

2. Amount payable to Lawpro, the indemnity company for lawyers: $50.00;

3. Allocation for courrier/messenger charges, photocopies, mileage and communications charges, inclusive of HST.: $52.50.

Incorporations

The basic fees for incorporations are $1,000.00 plus HST ($130.00) for an Ontario numbered company and a $500.00 additional fee plus HST. ($65.00) must be added where the client wishes to obtain the incorporation of a company with a corporate name to be discussed. If more than one incorporator is involved, an independent counsel for each of the incorporators must be involved.

The disbursement portion can be rounded to $600.00 which will include the following:

1. Amount to be paid to the Minister of Finance for the incorporation of the company: $360.00;

2. Estimate with respect to the obtaining of the minute book, the seal, the shares and the by-laws of the corporation: $180.00

3. Allocation for courrier/messenger charges, photocopies, mileage and communications charges, inclusive of HST.: $56.50.

4. Where a corporate name is requested, an additional disbursement is $150.00 is to be budgeted by the client.
